NBA Presents Comprehensive Recommendations for Electoral Act Amendment to Enhance Electoral Process

The Nigerian Bar Association (NBA) has formally presented a comprehensive set of recommendations to the House of Representatives for amendments to the Electoral Act 2022. These proposals are designed to address various challenges and shortcomings in the current electoral process, with the ultimate goal of enhancing the integrity, transparency, and inclusivity of elections in Nigeria.


The NBA's recommendations cover a wide range of critical areas, including legal standing in pre-election matters, candidate substitution, internal party democracy, technology and electoral integrity, and the establishment of an Electoral Offences Commission. Specifically, the NBA suggests restricting legal standing in pre-election matters to only aspirants within the same political party and retaining the 14-day filing window for timely resolution. Additionally, the association proposes limiting candidate substitution to cases of death or voluntary withdrawal, backed by affidavit and documentation, to prevent abuse of the electoral process.

The NBA also emphasizes the importance of leveraging technology to enhance electoral integrity. To this end, the association recommends making the Biometric Voter Accreditation System (BVAS) mandatory for voter accreditation and recognizing electronic transmission of results to the electronic transmission of results to the Innovation for Development (IReV) platform. This would help to reduce the incidence of electoral disputes and improve the overall credibility of the electoral process.

Another key proposal is the establishment of an independent Electoral Offences Commission with prosecutorial powers to address electoral malpractices such as vote-buying, violence, and result manipulation. This Commission would play a crucial role in deterring and punishing electoral offenses, thereby enhancing the integrity of the electoral process.

The NBA's recommendations are aimed at strengthening the electoral process and ensuring that elections in Nigeria are conducted in a free, fair, and credible manner. By addressing the challenges and shortcomings in the current electoral system, these proposals have the potential to significantly improve the quality of democracy in Nigeria. The NBA's commitment to electoral reform is evident in its efforts to engage with the National Assembly and other stakeholders to ensure the successful passage of these amendments.
